1. What this service is

Makutano Connect is business messaging and booking infrastructure. It receives enquiries and orders from your website, forms and WhatsApp, stores them against your account, and lets you and your team respond. It is operated by Makutano ("we", "us"). By creating an account you agree to these terms.

2. Your account

  • You must give accurate details and keep your sign-in credentials secure.
  • The person who creates the account becomes its Owner and is responsible for who else they invite.
  • You are responsible for everything done under your account, including by your team members and your API keys.
  • Tell us promptly if you believe your account or an API key has been compromised.

3. Trials, plans and billing

  • New accounts may start on a free trial. No payment details are required to begin one.
  • Each plan carries its own limits and features. These are enforced by the service, not merely advertised.
  • When a trial ends, the account stays available on the terms of the plan you select. We will tell you before anything is charged.
  • Fees are stated on your chosen plan and are non-refundable except where the law requires otherwise.

4. WhatsApp and messaging rules

Messaging through WhatsApp is additionally governed by Meta's WhatsApp Business Messaging Policy. Those rules sit above your plan: no plan, setting or agreement with us permits you to break them.

  • Message only people who have given you permission to contact them.
  • Honour opt-outs immediately and permanently. The service enforces this for you.
  • Outside a 24-hour service window, only templates approved by Meta may be sent.
  • Do not send unsolicited bulk messages, or scrape contacts from groups or third-party lists.

Meta may restrict or disable a number that breaches its policy. We cannot override that.

5. Acceptable use

You may not use the service to:

  • break any applicable law, or send unlawful, deceptive or harassing content;
  • impersonate another business or person;
  • attempt to access another customer's data, or probe, scan or overload the service;
  • resell access without a written agreement with us.

6. Your data

Your business data — customers, enquiries, orders, quotations and message history — belongs to you. We process it to run the service for you, as described in our Privacy Policy. You can export it through the API at any time while your account is open.

7. Availability

We work to keep the service available and take regular backups, but we do not promise uninterrupted service. Planned maintenance will be announced where practical. The service is provided "as is" to the extent permitted by law.

8. Suspension and closure

  • We may suspend an account for non-payment, for a breach of these terms, or where required by Meta or by law.
  • A suspended account keeps its data and stays readable; new writes are blocked until the matter is resolved.
  • You may close your account at any time. Tell us before you do if you want an export.
  • After closure we retain data only as long as needed for legal and accounting purposes, then delete it.

9. Liability

To the extent permitted by law, our total liability arising out of the service is limited to the fees you paid in the twelve months before the claim. We are not liable for lost profits or indirect losses.

10. Changes

We may update these terms. Material changes will be notified by email or in the portal before they take effect. Continuing to use the service after that means you accept the updated terms.

11. Governing law

These terms are governed by the laws of the United Republic of Tanzania.
